8 Year Court Battle Results in a Victory for Cohabitees

The Family and Private Client Team highlight the importance of cohabitees putting the right legal safeguards in place following a high profile Court case decided yesterday. 

Denise Brewster has fought an 8-year Court battle to secure provision from her deceased partner’s pension. It remains to be seen whether this case will be a landmark decision impacting on other public sector pensions and inheritance tax rules. It does, however, clearly highlight the fact that there is no such thing as a common-law husband or wife and shows the importance of putting arrangements into place such as Wills, Cohabitation agreements and pension nomination forms.
