Proactive Communication to help speed up the process

Whether you’ve found your new home or have found a buyer for your home, your next question is likely to be “how long does the conveyancing take?” There isn’t a precise answer to this question because the circumstances of each conveyancing transaction are different. However, typically it takes 8-12 weeks to complete the conveyancing process from when conveyancing solicitors have been instructed. It can be shorter, and it can take longer.

At Bradley Haynes Law we will reply to your calls and emails promptly. With your agreement, we will also keep key stakeholders, such as the estate agent, up to date which ensures that everyone knows what’s happening. From the outset, we will allocate a property lawyer to handle your case from start to finish. This means that they will be able to talk to you knowledgeably about your case.

To ensure your transaction proceeds as quickly as possible, it’s important that your solicitors are proactive throughout the conveyancing process. This means that typically, they will chase up aspects of the transaction that are required rather than simply waiting for something to happen. For example, the buyer’s conveyancing solicitors regularly chasing the seller’s solicitors for the sale contract ensures the purchase moves forward at the earliest opportunity. Without this pro-activity, the progress of your transaction will be impacted by the speed of others involved in the transaction who may not have the same priorities as you.

Instruct Us

Upon instructing us, we will issue a Welcome Pack to you, which will include our Client Care Letter and Terms of Business. Together, these documents form the contract which governs the entire relationship between you and us. They will expressly set out the agreed costs, disbursements, conveyancing process, the timescales, the agreed scope of work and the team members acting on your matter.

The Legal Stuff!

Both the buyer’s and seller’s solicitors will require their clients to complete identity checks and agree their terms of business at the outset of the transaction.

The conveyancing solicitor acting for the seller is responsible for obtaining information from the seller about the property and passing that to the buyer’s solicitor.

The conveyancing solicitor acting for the buyer is responsible for investigating whether the buyer will acquire good and marketable ownership of the property.

Exchange & Completion

When the buyer’s solicitors have completed their investigations and the buyer is happy to proceed with the purchase, the solicitors will exchange contracts.

On exchange of contracts, the solicitors agree on a date for completion of the transaction which is, typically one week after the exchange of contracts. It can be longer or shorter; it’s a matter of agreement between the parties.
