Upcoming changes to Probate Application Fees, by Kate Collins

From the 26th January 2022, the fee to submit an application to obtain a Grant of Probate will increase to a flat fee of £273.00. This fee will apply to both professional and non-professional users of the probate service, regardless of the size of the Estate, provided the total value of the Estate is over £5,000.
The Law Society have confirmed they support the Ministry of Justice’s aim to make a simpler and more concise process for users of the probate service, whilst acknowledging that funds are needed to facilitate this development.
Stephanie Boyce, the Law Society president, has commented further to say:
“we query why the UK government has decided to increase fees at this time, particularly as the probate service is still facing delays. In 2020, people had to wait 12 to 14 weeks on average to receive their grant. This is unacceptable, the service must be timely and allow executors to settle a loved one’s estate”.
It is not yet clear if non-professional applicants will still need to complete additional forms to determine the inheritance tax payable on an estate, but it seems there will still be an option to submit a postal application for the time being. Professional applicants must submit all applications using the online portal service.
It is important to remember that not all Estates require a Grant of Probate, however all Estates do require Estate Administration. The requirement for the Grant of Probate depends on the assets held within the Estate and how these are being transferred to beneficiaries.
